I know what it is like to be an immigrant to the US. Born and raised in Argentina, I came to the United States in 2008. Since arriving, I have held several immigration statuses. The first time, I came with a J-1 visa, and the second time with a fiancé visa. Then, I became a conditional permanent resident. Two years later, I was able to remove the condition on my residency. Finally, after many years, I became a citizen of the United States.

I know the fear, the uncertainty, and the anxiety that a person experiences while passing through the various and confusing immigration processes. I've been there. Business Immigration

An individual may obtain temporary or permanent residence in the United States based on employment, self-employment, or an investment. Some of the available visas are:

There are 6 requirements to become a US citizen through the naturalization process. You must:

  • Be at least 18 years of age at the time of the application;
  • Be a permanent resident (have a “Green Card”) and demonstrate continued residency in the United States for at least 5 years, or 3 years if you obtained your green card by marriage to a US citizen;
  • Demonstrate that you have been physically present in the United States for at least half of that time;
  • Be a person of good moral character;
  • Read, write and speak basic English (subject to exceptions); and
  • Have a basic understanding of US history and government and demonstrate attachment to the principles and ideals of the United States Constitution.

Family-based Immigration

Family immigration is the process by which a foreign citizen is sponsored by a US citizen or a legal permanent resident (holder of a Green Card).

A citizen of the United States may sponsor and petition spouses, fiancées, parents, children, and siblings.

A permanent resident of the United States may petition spouses and children.


Deportation proceedings are initiated by the government when it considers that an individual violated an immigration law. Deportation proceedings begin when the government issues a Notice of Appearance (NTA) to an immigration judge.

The most important thing to remember is that just because deportation proceedings have begun, this does not mean that you will be deported from the United States. There are multiple defenses in deportation cases. For example, you may be eligible for deferred action, asylum, or cancellation of deportation.

Before making any type of investment, the first step should always be to consult with an immigration lawyer, who specializes in this type of visa. We advise our clients what types of investments qualify for an E-2 visa. We also specialize in forming companies, drafting business plans, and advising investors on the legal requirements for establishing a business in the United States.

Process times vary depending on where the visa petition is filed. If the investor is present in the United States, he can apply for the E-2 visa with the US Citizenship and Immigration Service (USCIS) and wait for the decision in the United States. USCIS offers two levels of services: Premium and Regular. With the Premium service, USCIS is required to adjudicate the E-2 visa petition within a maximum of 15 calendar days. Under the Regular service, USCIS usually takes 3-4 months to adjudicate such requests.

If the investor is outside the United States, the petition must be filed at the US Embassy or Consulate where the investor resides. Processing times vary according to the Embassy or Consulate where the request is filed. If you received a “Notice to Appear” (NTA), this means that you are in removal/deportation proceedings. You may, however, be eligible for certain defenses to avoid being deported. These defenses include cancellation of deportation, asylum, naturalization, suspension of deportation, among others.

A person who has been persecuted or is fearful of persecution based on race, religion, nationality, political opinion, or membership in a specific social group may seek asylum in the United States.

The person must submit their asylum application within the first year of the date of arrival in the United States (subject to certain exceptions).

The Violence Against Women Act (VAWA) allows certain victims of domestic violence to become permanent residents of the United States. You may qualify if you are the spouse, child, or parent of a US citizen or the spouse or child of a permanent resident.

You can file an immigrant visa petition, and then obtain the residency without the abuser's knowledge. This allow victims to feel secure and to become independent of the abuser.

The provisions of VAWA apply equally to women and men.
